House Bill 389 (the "Triggerman Bill") is on the
docket for Wednesday, Febrary 22. As you know, this bill should be
defeated because it would be an unnecessary, dangerous and expensive expansion
of capital punishment in our state.

Bill 389 to repeal the "triggerman rule" passed 72 Y - 28 N in the
House of Delegates. Please call or email to thank the twenty-eight who voted against the bill.
The bill will next cross over to the Senate Courts of Justice Committee - we will alert you when this happens. It
will be important to do all we can to ensure it meets the same fate
there as SB 58, which last week failed to garner sufficient votes to be

Abolitionists,
At
the hearing Wednesday afternoon, February 8th, Senate Bill 58 failed to win the support of
a sufficicient number of votes in the Senate Courts of Justice
Committee and therefore failed to pass.
All seven Democrats voted against the bill, and seven Republicans voted in favor. One Republican, Senator Stanley,
abstained and did not vote. His stated reason was that he works on
capital cases as a court appointed defense counsel and therefore has
financial interests in the outcome.
Please be sure to
thank all the Democrats (listed below) who voted against this attempt at
expanding the death penalty in Virginia.
What comes next? The
House will approve their version of this bill and then that bill will
cross over to the Senate Courts of Justice Committee. We will need to muster the same effort from you when that version of the bill comes again before the Senate Committee.
This time we want to get at least one Republican to join us in saying
"NO" to death penalty expansion in Virginia! We will keep you informed
as to when this bill will be heard.

1. Senate Bill 58 seeks to
repeal the Virginia rule that, with three exceptions, accessories to
capital murder are not subject to the death penalty. This rule is
often referred to as the "Triggerman Rule." This phrase is a misnomer,
because under current Virginia law, all those who participate in a
killing that qualifies as capital murder can be prosecuted for capital
murder even if they did not "pull the trigger" that caused the killing.
For example, John Allen Muhammad, who was the spotter in the sniper
shootings, was successfully prosecuted for capital murder even though
he did not shoot any of the victims. Because current Virginia law
already makes the "worst of the worst" subject to the death penalty, SB 58 is not necessary.
2. In today's world, in
which we are reminded almost daily that our criminal justice system
makes mistakes and convicts innocent persons, we should not be
expanding capital punishment by making additional categories of
defendants subject to the death penalty. Senate Bill 58 will
increase the risk that Virginia will execute an innocent person.
3. In addition, because
capital cases are so expensive to prosecute and because the bill would
increase the number of capital prosecutions, there will be a
substantial fiscal impact on the Commonwealth if Senate Bill 58 becomes law.
