The 2001 General Assembly unanimously passed a bill to ease restrictions on presenting and testing of DNA only, in all felony cases, including death penalty cases. DNA is an issue in a small percentage of death penalty cases. VADP argues that the new law does not go far enough and sets the standards for allowing DNA testing too high. This bill just scratches the 21- Day Rule, and by no means addresses the issues of the unfairness of allowing only 21 days to introduce evidence of innocence in court. |
